Terms of Use & Communications Consent
1. Who we are — definitions
realestateapp.com is a real-estate search and listing platform serving North Alabama and surrounding areas. Together with its affiliated county real-estate sites, which share one account system, it forms the "Network." The Network displays listings from participating multiple listing services (MLS) under license, listings posted directly by property owners, and tools such as home-value estimates, saved searches, alerts, and agent directories.
The Network is owned and operated by Realty and Auction LLC ("we," "us," "our," or "the operator"). Every reference in these Terms to the Network's operator means Realty and Auction LLC.
2. Agreement
By using any Network site, and especially by creating an account, saving a home or search, sending an inquiry, or registering for full listing access, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the Network. Account holders affirm they are at least 18 years old and that the information they give us is accurate.
3. Communications — definition and consent
When you create an account, send an inquiry, request a call, save a home or search, enable an alert, post a listing, or register for full listing access, you consent to receive Communications from the Network and — where you have separately agreed, such as by sending an inquiry about a property or being introduced by your agent — from affiliated real-estate licensees, about your account, your property search, homes and searches you save, alerts you enable, listings you post, inquiries you send, and services you use.
"Communications" means: notifications (including web and app push notifications delivered through your browser or device), email messages, and telephone calls to a number you provide — together with any comparable channel the Network supports in the future. Your consent covers each of these channels whether or not every channel is in use at any given time. Consent to Communications is not a condition of buying, selling, or leasing any property.
Every channel has its own off switch, and turning one off never turns off the others unless you say so:
- Notifications — disable them in your browser or device settings, or from the notifications control on the site.
- Email — listing and search alerts have on/off switches in your account and in every alert email; account and transaction emails (for example, a password reset you requested or a receipt) are sent as part of operating your account.
- Phone — tell any caller, or ask us through the site, and calls to you stop.
The Network does not send SMS/text-message marketing.
4. Listing data — MLS content
MLS listing information displayed on the Network is provided under license from the participating MLS(s) through participating brokerages. It is deemed reliable but not guaranteed and should be independently verified before you rely on it. The MLS, the listing brokerages, and the Network's operator retain all rights in the listing data. You agree to use listing information only for your own personal, non-commercial evaluation of properties, and you agree not to copy, scrape, harvest, redistribute, retransmit, resell, or build datasets or derivative products from it, and not to access the Network by automated means except ordinary search-engine indexing of public pages.
Access to sold prices and off-market history (a "Virtual Office Website" under National Association of REALTORS® policy) requires registration and acceptance of the registration terms presented at that time, which are part of these Terms. Your registration record is retained and may be made available to the MLS on request, as MLS policy requires.
5. Home-value estimates
REApp Value and any other estimate, valuation, or market figure produced by the Network is an automated estimate, not an appraisal, and is not prepared by a licensed appraiser. Estimates can be wrong, sometimes materially. They are provided for your general information only and must not be relied on for lending, purchase, sale, tax, insurance, legal, or any other decision. For a definitive opinion of value, engage a licensed appraiser or a real-estate professional who has seen the property.
6. Owner-posted listings and other user content
Some listings on the Network are posted directly by property owners or their representatives, who attest that their information is accurate and that they have the right to list the property. The Network reviews owner listings before publication but does not verify them and does not guarantee their accuracy. Reviews, listing descriptions, photos, and other content submitted by users are the responsibility of the person who posted them. By submitting content you grant the Network a license to display it on the Network and in Network communications, and you affirm you have the right to post it. The Network may decline, edit for format, or remove user content at its discretion.
7. No brokerage relationship
Using the Network does not create an agency or brokerage relationship between you and the Network's operator or any licensee. In Alabama and most states, a brokerage relationship is formed only by a separate, explicit agreement with a licensee, accompanied by the disclosures state law requires. Licensees featured on the Network are independent professionals responsible for their own conduct and their own compliance with license law.
8. Accounts
Keep your password private; you are responsible for activity under your account. We may suspend or close accounts used in violation of these Terms — including scraping, misrepresentation, posting listings you have no right to post, or abuse of other users or licensees. You may close your account at any time from your account page; some records (for example, consent records, MLS-required registration records, and transaction records) are retained as law or MLS policy requires.
9. Paid products and payments
Where the Network offers paid business products, prices and terms are shown at checkout. Card payments are processed by third-party payment processors; the Network does not store your full card number. Subscriptions renew and cancel as described on your billing page; canceling stops future charges and leaves service active through the period already paid.
10. Prohibited uses
- Scraping, harvesting, or automated collection of listing data or personal information;
- Reselling, republishing, or commercially exploiting Network data or content;
- Posting false, misleading, or infringing listings or content;
- Impersonating another person or licensee, or misstating your licensure;
- Interfering with the Network's operation or attempting to access data or accounts that are not yours.
11. Disclaimers
The Network is provided "as is" and "as available." To the fullest extent permitted by law, the Network's operator disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and does not warrant that the Network will be uninterrupted, error-free, or that any listing, estimate, or other information is accurate or complete.
12. Limitation of liability
To the fullest extent permitted by law, the Network's operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost opportunities, or decisions made in reliance on Network information — including listing data, estimates, owner-posted content, or communications relayed between users and licensees. The operator's total liability for any claim relating to the Network is limited to the greater of the amount you paid the Network in the twelve months before the claim or one hundred dollars ($100).
13. Indemnification
You agree to indemnify and hold harmless the Network's operator from claims arising out of your content, your use of the Network in violation of these Terms, or your violation of law or third-party rights.
14. Changes
We may update these Terms. When we do, we will update the version and effective date on this page and, for material changes, notify account holders by a Communication. Continued use of the Network after a change takes effect is acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located in Alabama.
